1. This is an application for condonation of delay in filing an appeal under Section 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the order dated 21.11.2024 passed by the learned Special Court in Special Case No. 619 of 2024.
2. The learned counsel for the applicants/appellants submits that initially a Writ Petition bearing Writ Petition No. 6680 of 2024 was filed before this Court and by order dated 5.3.2026, this Court permitted the petitioners to withdraw the said petition with liberty to file an appeal under Section 14A of the SC & ST Act. It is Dinesh S. Sherla 1/2
30-ia-2203-26.odt submitted that thus the delay of 548 days occurred in filing the present appeal.
3. On the other hand, the learned counsel appearing for respondent Nos. 1 to 3 submits that the reason assigned cannot be said to be sufficient cause to condone the delay.
4. The fact that initially writ petition was filed and the same was pending for considerable time is not disputed. Considering the said fact, I am inclined to condone the delay. In the result, the following order is passed.
ORDER a) The Interim Application is allowed. b) The delay in filing the appeal is condoned. c) Criminal Appeal (St) No.12952 of 2026 be listed for admission on 30.10.2026.
