Lokayuktha and others ...Respondents ********** Advocate for Petitioners: Mr. P. Vivek appearing vice Mr. Venkateswarlu Posani Advocates for Respondents: GP for Revenue CORAM :THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : 10th February, 2026. P C : The present Writ Petition has been filed challenging the orders dated 02.08.2011 and 15.02.2011 passed by the Andhra Pradesh Lokayukta/respondent No.1 herein, in Complaint No.1229/2008/B1, whereby the District Collector was directed to issue instructions to the Revenue Divisional Officer as well as the Tahsildar concerned to stop further constructions on the land claimed by the complainant, namely Sri Swamy Hathiramji Mutt/respondent No.7 herein. A further direction was issued to evict the encroachers and remove the illegal structures. Page 2 of 3 HCJ & CGRJ WP_26935_2011 2. In the complaint filed by Sri Swamy Hathiramji Mutt, Tirupati, addressed to the office of the Lokayukta, it was alleged that the lands falling in Survey Nos.13 and 15 of Avilala Village in Tirupati, belonging to the Mutt, were being trespassed upon and encroached, and that the police and revenue authorities had not rendered any support on the ground till date and had remained silent. 3. The orders passed by the Lokayukta in Complaint No.1229/B1/2008 also came to be challenged by similarly situated persons in W.P.Nos.28005 and 24048 of 2011, wherein a coordinate Bench of this Court, vide judgment and order dated 10.07.2019, held that the orders passed by the Lokayukta were beyond the powers conferred on it and accordingly set aside the impugned directions. 4. In the present case, the same directions have been challenged by a different set of petitioners. Therefore, the judgment and order rendered in W.P.Nos.28005 and 24048 of 2011 would squarely cover the issue in the present Writ Petition as well. 5. Be that as it may, the present Writ Petition is allowed. The judgment and order dated 10.07.2019 passed in W.P.Nos.28005 and 24048 of 2011 shall apply on similar terms to the present case as well. No costs. Consequently, pending miscellaneous applications, if any, in this case, shall stand closed. p. 3 HCJ & CGRJ WP_26935_2011 Registry is directed to append a copy of the judgment and order dated 10.07.2019 passed in W.P.Nos.28005 and 24048 of 2011 to this order.
