APHC010101882026 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI WRIT APPEAL NO: 205 of 2026 along with W.A. Nos.206, 207 and 208 of 2026 Bench Sr.No:-7 [3446] M/s. Shapoorji Pallonji And Company Pvt. Ltd ...Appellant Vs. Union Of India and Others ...Respondent(s) ********** Advocate for Appellant: Mr. C.V. Mohan Reddy, Senior Counsel, appearing vice Mr. Divya Prasad Advocate(s) for Respondent(s): Mrs. M Uma Devi (Central Govt Counsel) Mr. V. Kalyan Chakravarthi, representing Mr. U.R.P. Srinivas, SC for ESIC CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE R RAGHUNANDAN RAO DATE : 26th February 2026 P C : The present writ appeals have been preferred against the orders, dated 08.01.2026, passed in W.P. Nos. 32881, 32887, 32884 and 32891 of 2025 respectively. 2. By virtue of the order, dated 10.12.2025, the learned single Judge ordered interim suspension of the impugned proceedings, dated 03.11.2025, 2 HCJ & RRR, J W.A. No: 205 of 2026 & Batch subject to the condition that the petitioner deposits 25% of the amount which was reflected in the proceedings, within a period of four weeks. 3. Learned counsel for the appellant would submit that in similar circumstances, for the same period i.e., 01.06.2020 to 31.10.2024, another Bench in W.P. No.32027 of 2025 had found a prima facie case in favour of the appellant by observing that the appellant had been declared a defaulter for the period between 01.06.2020 to 31.10.2024 even when the work had stopped as early as June, 2019 and that calling upon the petitioner to pay all the contributions determined by the said respondents in those circumstances would require consideration and therefore, the learned single Judge in W.P. No.32027 of 2025 had ordered interim suspension of the impugned proceedings. The case of the appellant is that since the circumstances were similar as also the demand raised was for the same period, the order which was earlier passed in W.P. No.32027 of 2025 ought to have been considered and similar relief granted. 4. Having considered the arguments of learned counsel for the parties, we are of the opinion that since the learned single Judge in at least one case found a prima facie case in favour of the appellant herein, a similar order prima facie could have been passed in favour of the appellant pending final consideration in all these petitions. 3 HCJ & RRR, J W.A. No: 205 of 2026 & Batch 5. Be that as it may, we order interim suspension of the impugned proceedings till the issue is decided by the learned single Judge. Registry to list W.P. Nos.32881, 32884, 32887 & 32891 of 2025 before the learned single Judge having roster on 05.03.2026 for consideration. The writ appeals are, accordingly, disposed of. No costs. Pending miscellaneous applications, if any, shall stand closed. DHIRAJ SINGH THAKUR, CJ R. RAGHUNANDAN RAO,J akn 4 HCJ & RRR, J W.A.
