02/23.06.2026 Heard Md. Razaullah Ansari, learned counsel for the petitioner and learned P.P. as well as Md. Ayub Ansari,
learned counsel appearing for the informant.
This application is directed against the order dated 30.04.2026 passed in Criminal (Misc.) Appeal No. 23/2026, by the learned District & Additional Sessions Judge-I-cum-Special Judge Children Court, Giridih, whereby and whereunder, the order dated 11.03.2026 passed by the learned Principal Magistrate, Juvenile Justice Board, Giridih in connection with Bagodar P.S. Case No. 20/2026, rejecting the prayer for bail of the petitioner has been affirmed.
It has been alleged that the marriage of the daughter of the informant was solemnized with Jabir Ansari about four years back and after the marriage the daughter of the informant was subjected to torture on account of non-fulfillment of the demand of dowry. On 28.01.2026, the daughter of the informant went missing and despite a search she could not be located and ultimately on an information that a dead body in a burnt condition was lying in Karipahari forest the informant had gone and identified the dead body as that of his daughter.
Submission has been advanced by the learned counsel for the petitioner that the petitioner is not related to the deceased and is nowhere connected with the said offence. It has been submitted that the petitioner has been implicated on the confessional statement one Jaibun Khatun who is the mother-in-law of the deceased. It has been submitted that one of the co-accused Vakil Ansari has been granted bail by this Court in B.A. No. 3880 of 2026.
Learned counsel for the petitioner adds that the petitioner is in remand home since 05.02.2026.
Learned P.P. as well as learned counsel for the informant have opposed the prayer for bail of the petitioner. Md. Ayub Ansari, learned counsel appearing for the informant has submitted that the petitioner was the person who was primarily responsible for committing the murder. It has further been submitted that there are strong circumstances about the involvement of the petitioner in such offence.
It appears that the implication of the petitioner stems from the confessional statement of the co-accused and neither there is any eye-witness to the incident nor any incriminating materials have been collected save and except the confessional statement of the mother-in-law of the deceased Jaibun Khatun from which the role of the petitioner in the commission of the murder could be deciphered.
Regard being had to the above, while setting aside the order dated 30.04.2026 passed in Criminal (Misc.) Appeal No. 23/2026, by the learned District & Additional Sessions Judge-I-cum-Special Judge Children Court, Giridih and the order dated 11.03.2026 passed by the learned Principal Magistrate, Juvenile Justice Board, Giridih in connection with Bagodar P.S. Case No. 20/2026,
-2-
the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Principal Magistrate, Juvenile Justice Board, Giridih in connection with Bagodar P.S. Case No. 20/2026, subject to the condition that the father of the petitioner shall ensure the safety of the petitioner and shall also ensure that the petitioner is not allowed to mix with any anti-social elements.
This application stands allowed.
