Earlier prayer for bail of the petitioner was rejected by the Co- ordinate Bench on merits vide order dated 07.05.2025 passed in B.A. No.2995 of 2024. The petitioner, above-named, who is in custody in connection with Bhandra (Lohardaga) P.S. Case No. 05 of 2022 (Spl. POCSO Case No.35/ 2022) for the offence registered under Sections 376-DA/ 34 of the Indian Penal Code and under Section 4 /6 of POCSO Act, has renewed his prayer for regular bail. It is submitted by the learned counsel on behalf of petitioner that prayer for bail has been renewed on the ground that out of 14 witnesses, ten witnesses have already been examined. Learned A.P.P. for the State has opposed the prayer for bail. It is submitted that the matter involves gang rape in which co-accused has already been convicted by the learned Trial Court. Considering the nature of allegation and gravity of offence, this Court does not find any change of circumstance in this bail application filed for renewal of bail and accordingly, the same is hereby again rejected.
