This application is directed against the order dated 23.04.2026 passed by the learned Special Judge, Children Court, Dhanbad in Criminal Appeal No. 72/2026, whereby and whereunder, the order dated 19.02.2026 passed by the learned Principal Magistrate, Juvenile Justice Board, Dhanbad in connection with Katras P.S. Case No. 434/2025 rejecting the prayer for bail of the appellant has been affirmed.
It has been submitted by learned counsel for the petitioner that the allegations on the face of it appears to be improbable. Learned counsel submits that the petitioner is a juvenile, while the victim upon whom the petitioner is alleged to have committed rape is almost 60 years of age. Learned counsel submits that the Social Investigation Report is not adverse to the cause of the petitioner and the petitioner is in custody since
16.12.2025.
Learned A.P.P. has opposed the prayer made in this application.
The allegations reveal that when the informant who is aged about 58 years was at her home, the petitioner and two other persons had forcibly entered into her house and while the

other persons had caught hold of her hand, the petitioner is said to have committed rape upon her.
The Social Investigation Report reveals that the behaviour of the appellant is good as per the neighbours and he is a student of Intermediate who also works in a Steel Plant at Aligarh having no criminal antecedents.
Regard being had to the prima facie improbable nature of allegations levelled against the petitioner and considering the Social Investigation Report as well as the period of custody undergone by the petitioner, while setting aside the
order dated 19.02.2026 passed by the learned Principal Magistrate, Juvenile Justice Board, Dhanbad in connection with Katras P.S. Case No. 434/2025 and 23.04.2026 passed by the learned Special Judge, Children Court, Dhanbad in Criminal Appeal No. 72/2026, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each, to the satisfaction of learned Principal Magistrate, Juvenile Justice Board, Dhanbad in connection with Katras P.S. Case No. 434/2025, subject to the condition that the father of the petitioner shall take care of the welfare of the petitioner and shall prevent him to mix with anti-social elements.
