APP Mr. Ujjwal Luksom ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 39 days and is a Doctor who has been falsely implicated. Learned advocate for the State has produced the case diary. I have considered the statement of the victim under Section 183 of the BNSS. Having considered the totality of the circumstances I am inclined to release the petitioner on bail. 2 Petitioner, namely, Avilash Prasad Gupta shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned CJM, Darjeeling. As the investigation of the case is in progress petitioner shall once in a fortnight meet with the Investigating Officer of the case till further orders. Accordingly, CRM (M) 24 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
