In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Hingalgunj Police Station Case No. 5 of 2025 dated 04.01.2025 under Sections 14A(b) of Foreigners Act. ……for the State. A report has been submitted which reflects that the petitioner surreptitiously entered India and married one Mukunda Gayen. An enquiry has been conducted by the SDPO earlier. A further detailed enquiry was conducted by the Officer-in-Charge, Hingalgunj Police Station through an Officer deputed by him wherein informations were collected from the concerned Gram Panchayat and also local people. Prima facie, I find that the plea taken up by the petitioner appears to be correct but the mode and manner in which she entered India is not acceptable. Having considered that there is a marital relationship between the petitioner and one Mukunda Gayen, I am of the
2 view that further detention of the petitioner is not called for in the peculiar backgrounds of the facts of the present case as has been reflected from the different documents placed by the petitioner and the report submitted on behalf of the State. Accordingly, the prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Maya Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned ACJM, Basirhat. If on bail, the petitioner shall not leave the jurisdiction of Haringhata Police Station except for the purposes of attending the Court. Petitioner shall make herself available as and when required by the Hingalgunj Police Station. On the other hand, it is directed that till further orders of this Court a register be maintained by the Officer-in-Charge of Haringhata Police Station who would send a lady officer for cross-checking regarding the availability of the present petitioner at the address provided which is that of the deponent in the application for bail before this Court. Accordingly, CRM (M) 400 of 2026 is allowed. Report submitted by the State be kept with the record.
