That, this Hon'ble Court may be pleased to direct the respondent concerned to consider and count earlier service of the petitioner for grant of revised pay scale without insisting upon N.O.C. That, this Hon'ble court may kindle be pleased to quash the requirement of N.O.C. in circular dated 23.04.2016, in the interest of justice grant of salary to the petitioner from transfer order to date of joining, with normal rate of interest.” 2. Learned Counsel for the Petitioner submits that the Petitioner is entitled to the revised pay scale upon completion of 8 years of service. He further submits that the issue relating to grant of revised pay scale was considered by this Court in Mukesh Kumar Patel vs. State of Chhattisgarh & Anr. and a batch of connected Writ Petitions, wherein the circular dated 23.04.2016 was quashed. The said Writ Petitions were allowed with a direction that the Petitioners therein shall be entitled to the benefit of revised pay 3 scale on completion of 8 years of service by counting the services rendered by them on a lower post or on the same post. 3. In view of the aforesaid facts and circumstances, the Respondents are directed to consider the claim of the Petitioner in light of the decision rendered in Mukesh Kumar Patel (supra), in accordance with law, expeditiously, preferably within a period of three months from the date of receipt of a representation to be submitted by the Petitioner along with all relevant documents. 4.
