ORAL ORDER
The petitioner, a resident of Kerala, is before this Court calling in question one of the conditions imposed by the LIII Additional City Civil and Sessions Special Judge, Bengaluru c/c. LXI Additional City Civil and Sessions Judge, Bengaluru (CCH- 62), in Crl.Misc.No.5093/2025, by an order dated 12.08.2025, while considering a petition preferred by the petitioner seeking relaxation of bail condition, i.e., marking of attendance before the jurisdictional police bi-monthly, on the score that he is a resident of Kerala and the offence alleged is the one punishable under Section 420 of the IPC.

2. Heard Sri. Raghavan M., learned counsel appearing for the petitioner, Sri.B.N. Jagadeesha, learned Addl. SPP appearing for the respondent and have perused the material on record.
3. Learned counsel for petitioner submits that the concerned Court ought not to have directed marking of the attendance of the petitioner in the teeth of the said offence.
4. In that light, the said condition that is stipulated directing to mark the attendance of the petitioner before jurisdictional police bi-monthly stands obliterated.
5. For the aforesaid reasons, the following:
ORDER (i) The criminal petition is allowed. (ii) The order dated 12.08.2025 passed by the LIII Additional City Civil and Sessions Special Judge, Bengaluru c/c of LXI Additional City Civil and Sessions Judge, Bangalore (CCH-62) in Crl.Misc.No.093/2025, only in respect of the additional condition directing the

petitioner to mark his attendance before the respondent – police stands obliterated. (iii) Other conditions, if any, shall remain intact.
Ordered accordingly.
