By virtue of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks grant of regular bail in proceedings arising out of FIR No.140/2023 dated 02.04.2023 registered at PS: Anand Parbat under Sections 302/308/147/ 148/149/201/34 of the Indian Penal Code, 1860 (IPC). 2. Since Mr. Mohit Kapoor, Advocate appearing on behalf of the LRs/ kith and kins of the deceased/ affected persons, Ms. Anushkaa Arora, Standing Counsel, Delhi High Court Legal Services Committee is discharged from the present proceedings. Succinctly put, the present FIR was registered at the instance of the complainant who stated that his cousin, Karan, was stabbed to death on 01.04.2023 by his neighbour Pintu, Shivam, Golu Sardar and certain other persons who had been scolded by the complainant and his family members including Karan for creating a ruckus using abusive language in the street the previous day. When the complainant and his family members arrived at the spot where Karan had been stabbed, the accused persons, including the applicant herein, reached the spot and beat them with lathis/ dandas causing injuries to them. Karan was subsequently declared brought dead at BLK Hospital. 4. In these facts, this Court has heard learned counsel for the applicant, learned counsel for the complainant as well as the learned APP, and perused the documents and materials on record. 5. As per the factual matrix involved, there is no allegation against the applicant qua stabbing the deceased, as he is only stated to have arrived at the spot later when the accused persons allegedly wielded lathis/ dandas. Keeping that in mind, though the present FIR pertains to serious offences, the role attributed to the applicant is only of being present on the spot at the time of the alleged incident. The applicant was then a young boy about 19 years of age with clean antecedents. Today, he has already undergone a period of three years and five months in judicial custody, wherein his conduct has been ‘Satisfactory’ throughout. 6. Before the learned Trial Court, though the charges have been framed, however, since there are total 78 prosecution witnesses cited in the charge-sheet, the trial is evidently going to take substantial time. 7. Taking a cumulative view of the aforesaid facts and circumstances This is a digitally signed order. Accordingly, the present application is allowed and the applicant be released on regular bail in proceedings arising out of FIR No.140/2023 dated 02.04.2023 registered at PS: Anand Parbat under Sections 302/308/147/148/149 IPC, subject to him furnishing a personal bond in the sum of Rs.50,000/- [Rupees Fifty Thousand Only] along with one surety of the like amount by a family member/ friend having no criminal case pending against him/ her to the satisfaction of the learned Trial Court, and further subject to the following conditions: i. Applicant shall not leave NCT of Delhi without prior permission of this Court and shall ordinarily reside at the address as per prison records. If he wishes to change his residential address, he shall immediately intimate about the same to the concerned IO by way of an affidavit. ii. Applicant shall surrender his Passport, if any, to the concerned IO, within a period of three days. iii. Applicant shall appear before the Court as and when the matter is taken up for hearing. iv. Applicant shall provide all his mobile numbers to the concerned IO which shall be kept in working condition at all times. v. Applicant shall report to the IO at PS: Anand Parbat, Delhi once every month in the first week of the month unless leave of every such absence is obtained from the learned Trial Court. vi.
