The petitioners are apprehending their arrest in connection with Dhanwar P.S. Case No.55 of 2026, for the alleged offences registered under Sections 303(2), 317(4) and 317(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned J.M. 1st Class, Giridih. 3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in this case and the petitioners have no concern with the allegation of theft of gas cylinders. He further submits that the name of the petitioners have come on the confessional statement. On these grounds, he submits 2026:JHHC:18695 --2-- A.B.A. No. 3313 of 2026 that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposed the prayer and submits that even the petitioners have the criminal antecedent of identical nature and in view of that anticipatory bail may kindly be rejected. 5. The allegations are there of theft of 25 to 30 gas cylinders as well as 8 to 10 stolen motorcycles and the petitioners are said to be accomplice of apprehended co-accused and the petitioners are having criminal antecedent of identical nature. 6. In the attending facts and circumstances of this case, I am not inclined to grant anticipatory bail to the petitioners, hence, the prayer for anticipatory bail of the petitioners are hereby rejected.
