The present writ petition has been filed seeking a direction to the respondent no.1/MCD to demolish the unauthorized construction being carried out by the private respondents no.3 to 6 in the property bearing no. L-69, Kalkaji, New Delhi-110019 (‘subject property’). 2. Counsel appearing on behalf of the petitioner submits that the petitioner is a next-door neighbour. Status report has been filed on behalf of the respondent no.1/MCD. 3.1. A copy of the same has been handed over in Court and the same is taken on record. 4. As per the status report, a building plan was sanctioned in respect of the subject property permitting construction of Basement, Stilt and Ground Floor to Third Floor. 5. Deviations were found in the construction in the form of excess coverage which were booked and a show cause notice was issued on 26th May, 2026. Subsequently, a demolition order was issued on 14th July, 2026. 6. Thereafter the private respondents filed an application for grant of occupancy-cum-completion certificate, which was granted after compounding the unauthorised construction. A copy of the occupancy-cum- completion certificate has been filed along with the status report (Annexure- D to the status report). 7.
