107. BA-1460-26.odt Amberkar IN THE HIGH COURT OF JUDICATURE AT BOMBAY CRIMINAL APPELLATE JURISDICTION BAIL APPLICATION NO. 1460 OF 2026 Avinash Vinod Suryavanshi .. Applicant Versus The State of Maharashtra .. Respondent ....................  Mr. Ranjit Gangadhar Jadhav, Advocate for Applicant  Mr. Yogesh M. Nakhwa, APP for State  API - R.M. Kedar  PSI - Mulak, EOW, Nashik City ................... CORAM : MILIND N. JADHAV, J. DATE : OCTOBER 12, 2026 P. C. : 1. Heard Mr. Jadhav, learned Advocate for Applicant and Mr. Nakhwa, learned APP for State. 2. This is an Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking regular Bail in connection with FIR dated 27.03.2023 bearing CR No. 108/2023 registered with Mumbai Naka Police Station, Nashik City for the offences punishable under Sections 406, 409, 420 & 120(B) of the Indian Penal Code, 1860 (for short "IPC") and Sections 3 & 4 of Maharashtra Protection of Interest of Depositors Act, 1999. 3. Applicant is arraigned as accused No 1 in the present crime. He is one of the directors of Aadi Shakti Fortune Solutions LLP. Similarly 1 of 4 107. BA-1460-26.odt placed directors of the said Company have already been enlarged on bail. It is prima facie seen that the directors who have been enlarged on bail had accepted substantial deposits from investors to invest in the Company on short term basis for doubling their money within 11 months. All these accused persons have been enlarged on bail. 4. Insofar as the Applicant is concerned, role that is attributed to the Applicant is that he had transferred amounts of Rs. 15 Lakhs (approximately) through bank transfers and Rs. 6 Crores in cash to other co-accused persons. Considering the fact that all other co- accused persons have already been enlarged on bail, investigation having been completed and the Applicant having been incarcerated in prison for the past more than 3 years and 8 months pending trial, I am inclined to consider the case of the Applicant for grant of bail on the ground of parity as also on the ground of long incarceration since the trial will take a long time to conclude. Hence, Applicant is released on bail on the following terms and conditions:- (i) Applicant is directed to be immediately released on bail from prison in connection with CR No. 108/2023; (ii) Applicant is directed to be released on bail on furnishing P.R. Bond of Rs. 50,000/- (Rs. Fifty Thousand only) with one or two sureties in the like amount; 2 of 4 107. BA-1460-26.odt (iii) Applicant shall report to the Investigating Officer at concerned Police Station, once every month on the first Sunday of the month between 10:00 a.m. to 12:00 p.m.; (iv) Applicant shall co-operate with the conduct of trial and attend the Trial Court on all dates, unless specifically exempted and will not take any unnecessary adjournments, if he does so it will entitle the prosecution to apply for revocation of this order; (v) Applicant shall not leave the State of Maharashtra without prior permission of the Trial Court; (vi) Applicant shall not influence any of the witnesses or tamper with the evidence in any manner; (vii) Applicant shall keep the Investigating Officer informed of his current address and mobile contact number and / or change of residence or mobile details, if any, from time to time, as applicable; and (viii)Any infraction of the conditions shall entail cancellation of bail granted to the Applicant. 5. Needless to state that the above observations will not come in the way of trial as they are prima facie in nature based on the submissions made and the material placed before this Court. 3 of 4 107. BA-1460-26.odt 6. Bail Application is allowed and disposed of in the above terms. Amberkar [ MILIND N.
