CORAM:
THE HON’BLE MISS JUSTICE SAVITRI RATHO
Order No.
ORDER 11.05.2026
01. (Through hybrid mode)
1. The CRLMP has been filed for a direction to the IIC, Madhupatna Police Station (Opposite Party No.2) to register the FIR and immediately seize the CCTV footage of the Pahal Police Station Campus of the relevant date and time i.e. from 9.30 PM of 06.04.2026 to 10.30 PM of 07.04.2026 and store the CCTV footage for proper investigation of the case. 2. Mr. S.R. Tripathy, learned counsel for the Petitioner submits that the Petitioner works as Spare Parts Manager under Utkal Automobiles Pvt. Ltd. since November, 2019. On the allegation that due to shortage of spare parts of the company of the
value of Rs.50,57,905/-, on 06.04.2026, the Director of the Company called him to his office, abused him in filthy language and made the allegation of syphoning of the spare parts by the Petitioner. In spite of all efforts of the Petitioner to convince him and in spite of showing him all e-mails and reminders addressed to the Service Manager, demanding of remaining spare parts of value of Rs.17 lakhs and mentioning that internal audit had revealed that there are surplus spare parts of the value is Rs.16,75,852/-, the Service Manager did not reply to his e-mail but without considering the grievance of the Petitioner he was dragged to the Pahala Police Station and unlawfully restrained there without any written complaint for about 24 hours. On 07.04.2026, the IIC, Pahala Police Station compelled the Petitioner to admit that he is responsible for the shortage of stocks and put his signature in an undertaking already drafted by the Director of the Company. He was also forced to issue cheques against the cost of shortage of stock. He has issued 18 cheques, drawn on Panjab National Bank, Ranihat Branch and assured to give six cheques at the later stage. He has sent a lawyer notice to each of the authorities by Speed Post giving details of how he became a victim in the hands of the IIC, Pahala Police Station and the authorities of Utkal Automobilies. He thereafter sent an FIR
addressed to the Madhupatna Police Station and copies of the same to the higher authorities of police and Home Department with a request for seizure of CCTV footage of Pahala Police Station.
The Petitioner also lodged the FIR through online and received Permanent Complaint No.24862005072600018 dated 13.04.2026. He has annexed the Xerox copy of the FIR, postal receipts along with acknowledgement of online registration of FIR. 3. The legal notices sent to various authorities have not been annexed to the CRLMP. It is also apparent that the Petitioner has not complied with the provision of Section 173(4) of the BNSS inasmuch as the Petition sent to the concerned officer has not been annexed to this CRLMP nor has the officer been arrayed as an Opposite Party in this CRLMP. 4. Therefore, I am not inclined to entertain the CRLMP in exercise of power under Article 226 of the Constitution of India. 5. It is open to the Petitioner to comply with the provision of Section 173(4) of the BNSS and avail the alternate remedy which is available to him under law. (Savitri Ratho)
