1. Heard Mr. Amit Kumar Chaki, learned counsel for the petitioners, and Mr. Saumya Rai, learned Deputy Government Advocate, appearing for the State/respondent No. 1.
2. The present petition has been filed seeking restoration of CRMP No. 3277 of 2025, which came to be dismissed on account of non- deposit of a sum of Rs. 1,00,000/- before the Mediation Centre of this Court, as directed vide order dated 31.10.2025.

Learned counsel for the petitioners submits that the said amount could not be deposited within the stipulated period due to unavoidable circumstances beyond the control of the petitioners. It is further submitted that the default was neither deliberate nor intentional and that the petitioners are now ready and willing to comply with the earlier direction. A prayer has accordingly been made for restoration of the matter in the interest of justice.
4. Having considered the submissions advanced and upon perusal of the record, this Court is of the view that the earlier dismissal was on account of procedural non-compliance and not on merits. The right of adjudication on merits ought not to be defeated on technical grounds,
3 particularly when the petitioners express readiness to comply with the conditional order. At the same time, compliance of judicial directions must be ensured.
5. In the aforesaid circumstances, and in order to balance the equities between the parties, this Court deems it appropriate to grant one final opportunity to the petitioners to comply with the earlier direction.
6. Accordingly, petitioner No. 3 (husband) is directed to deposit a sum of Rs. 1,00,000/- before the Mediation Centre of this Court on or before 03.03.2026. The said amount shall be released to respondent No. 2 (wife) upon her appearance before the Mediation Centre of this Court.
7. Upon deposit of the aforesaid amount within the stipulated period and filing of the receipt evidencing such deposit before the Registry of this Court, CRMP No. 3277 of 2025 shall stand restored to its original number.
8. The Registry is directed to list the restored matter before the Mediation Centre on 09.03.2026. Thereafter, the matter shall be placed before the appropriate Bench along with the report of the Mediation Centre on 17.03.2026.
9. It is made clear that in the event of failure to deposit the aforesaid amount within the time granted, the present order shall automatically stand vacated and the earlier order of dismissal shall revive without further reference to the Court.

10. The present CRMP stands disposed off in the above terms.
