ARAVIND ORAL ORDER This petition under Section 483 of the Bharatiya Nagarika Suraksha Sanhita, 2023 (for short 'BNSS 2023') is by accused No.4 in Crime No.288/2025 registered by Ramamurthy Nagar Police Station, Bengaluru, for the offences punishable under Sections 61, 103(1) r/w Section 3(5) of Bharatiya Nyaya Sanhita (BNS) and Section 25(1)(B)(b) of the Arms Act. 2. Sri Chidananda H.M., learned counsel for the petitioner submits that there is no prima facie case against the petitioner and that he has been falsely implicated in this case and that the FIR does not indicate the name of any accused persons. Further, it is submitted that the charge sheet does not specify the allegations or the offences against the petitioner. It is further submitted that this Court in Crl.P.No.14715/2025 vide order dated 19.02.2026, had enlarged accused No.3 on bail subject to conditions. Hence, the learned counsel prays for similar order from this Court. 3. Smt. Rashmi Patel, learned High Court Government Pleader opposing the petition submits that if the petitioner is - 3 - HC-KAR NC: 2026:KHC:24809 CRL.P No. 5244 of 2026 enlarged on bail, there is a possibility of him not participating in the trial and may influence the prosecution witnesses. 4. Considering the submissions made by learned counsel for the petitioner and learned HCGP and on perusal of the FIR and the order passed by Co-ordinate Bench of this Court, this Court finds no grounds to deny bail to the petitioners. The petitioner would be entitled to bail as has been considered in the case of accused No.3. 5. In the light of the orders passed in Crl.P.No.14715/2025 dated 19.02.2026, the present petition requires to be allowed. Accordingly, this Court passes the following; ORDER (i) The Criminal Petition is allowed. (ii) The petitioner/accused No.4 in Crime No.288/2025 registered by Ramamurthy Nagar Police Station, Bengaluru, for the offences punishable under Sections 61, 103(1) r/w Section 3(5) of Bharatiya Nyaya Sanhita (BNS) and Section 25(1)(B)(b) of the Arms Act, is ordered to be enlarged on bail on execution a - 4 - HC-KAR NC: 2026:KHC:24809 CRL.P No. 5244 of 2026 personal bond for Rs.1 Lakh with one local surety for the likesum to the satisfaction of the trial Court; (iii) The petitioner/accused No.4 shall not threaten or tamper with the prosecution witnesses or hamper the proceedings of the Court. (iv) The petitioner/accused No.4 shall appear before the trial Court on all hearing dates without fail unless exempted. (v) The petitioner/accused No.4 shall not indulge in any criminal activities till disposal of the case. In case, if the petitioner violates any of the bail conditions as stated above, liberty is reserved to the prosecution to file necessary application for cancellation of bail. Sd/- (K. V.
