This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with Crime No.576/2017 registered at Police Station – Ambikapur, District: Surguja, C.G. for the offence punishable under Sections 420, 506, 120-B of IPC. 2. Case of the prosecution, in brief, is that F.I.R has been lodged on 09.10.2017 alleging that on 29.09.2017 the applicant and VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.02.28 10:27:48 +0530 2 complainant entered into a agreement to sell land of the complainant and complainant received Rs. 3,13,000/- as earnest money from the applicant. But thereafter the applicant and other co-accused person Akhilesh Soni & Others in connivance with each other have cheated the complainant by alluring him to sell gold brick and took Rs. 3,00,000/- from him and in turn handed him sealed packet which when opened by the complainant contained Stone. Hence the FIR was lodged. 3. Learned counsel for the applicant submitted that applicant is innocent and has been falsely implicated in this case. He also submits that applicants have neither committed nor participated in any such act which may amount to any of the offence. He also submits that applicant have no criminal antecedents and co-accused persons have already been granted bail by this Court vide orders dated MCRC No.6291 of 2018, 8518 of 2018 and 7678 of 2018 and another co-accused has granted anticipatory bail by this Court in MCRCA No.82 of 2019, therefore he prays for grant of anticipatory bail to the applicants. 4. On the other hand, learned State counsel, appearing for the non - applicants/State, opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the fact that co-accused persons have already been granted bail by this Court vide orders dated MCRC Nos.6291 of 2018, 8518 of 2018 and 7678 of 2018 and another co-accused has granted 3 anticipatory bail by this Court in MCRCA No.82 of 2019, therefore, I am inclined to grant anticipatory bail to the present applicants. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant No.1 Nohar Yadav and applicant No.2 Baleshwar on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
