JUSTICE S RACHAIAH) 1. The appellant is before this Court seeking to set aside the judgment and decree passed in M.C.No.97/2018 by the Senior Civil Judge and JMFC at Mandya. 2. The respondent herein - Sri. Chidananda C R, had filed a petition against the appellant herein under Section 13(1)(i)(a) of the Hindu Marriage Act, 1955 for dissolution of marriage solemnized on 12.11.2014 at Nagamangala. The Trial Court allowed the petition and the marriage solemnized between the appellant and the - 3 - HC-KAR NC: 2026:KHC:25292-DB MFA No. 672 of 2024 respondent on 12.11.2014 was dissolved by the decree of divorce. 3. Being aggrieved by the said order, the appellant / wife has challenged the said order before this Court by filing the present appeal. During the pendency of this appeal, on 15.12.2025, the parties were directed to appear before the Karnataka Mediation Centre to explore the possibility of settlement. 4. Pursuant to the order of this Court, the parties had appeared before the Karnataka Mediation Centre and resolved the dispute amicably and made available the said report before this Court. The contents of the said Memorandum of Agreement, which read as follows: "I. The appellant herein had filed the above appeal against the judgment and decree dated 02.11.2023 passed by Principal Senior Civil Judge and CJM, Mandya in M.C. No. 97/2018 dissolving the marriage between the appellant and the respondent. - 4 - HC-KAR NC: 2026:KHC:25292-DB MFA No. 672 of 2024 II. The above appeal was referred to mediation by the Hon'ble Court. Accordingly, the parties having participated in the mediation process. Both the parties have resolved their disputes under the following terms and conditions: 1. The Respondent agrees to pay a sum of Rs. 7,00,000/-(Rupees Seven Lakhs Only) to the appellant in full and final settlement of the claims involved in the above dispute. The aforesaid amount of Rs. 7,00,000/- (Rupees Seven Lakhs Only) is agreed to be paid through demand draft bearing No.891654 dated 17.03.2026 drawn on Bank of Baroda, Chandagali Branch, Nagamangala Taluk, Mandya District. 2. The parties herein have a daughter by name Chinmana C who is now aged about 9 years. The minor daughter is in the care and custody of the appellant herein and shall continue to be so in future for which the respondent/father has no objection. 3. The appellant herein agrees that she shall deposit the sum of Rs.4.00.000/- as fixed deposit in the name of the minor child and the same shall be used for welfare of the child after attains the age of 18 years. A sum of Rs.3,00,000/- (Rupees Three Lakhs Only) which is been given to the appellant shall be used for her necessities. 4. The appellant herein agrees to withdraw the case pending before the I Addl. Civil Judge and JMFC at Nagamangala, in Crl.Misc. District Mandya No.213/2023 filed by her seeking Maintenance for her and the minor child. - 5 - HC-KAR NC: 2026:KHC:25292-DB MFA No. 672 of 2024 5. Both the parties state that they have no claims of whatsoever nature with regard to movable or immovable properties belonging to each other either past, present or in future. 6. Both the parties agree not to interfere in the lives of each other in any manner or in any form in future. III. In view of the aforesaid agreement entered into between the parties, the parties humbly pray that this Hon'ble Court may be pleased to dispose off the above appeal, in terms of this settlement agreement arrived between the parties herein. IV. Parties will appear before the Hon'ble High Court of Karnataka, Bengaluru for passing appropriate orders in terms of the settlement agreement." 5. Having considered the settlement arrived at between the parties and also in order to secure the ends of justice between them, it is appropriate to dispose of this appeal in terms as stated above. 6. In the light of the observations made above, we proceed to pass the following:- - 6 - HC-KAR NC: 2026:KHC:25292-DB MFA No. 672 of 2024 ORDER (i) The appeal stands disposed of in terms of Memorandum of Agreement. (ii) The judgment in M.C.No. 97/2018 would stand substituted by the terms of the memorandum of settlement. The marriage of the petitioner and respondent on 12.11.2014 stands dissolved subject to the terms of the settlement contained in the memorandum of agreement referred to above.
