ORAL ORDER
This Criminal Petition is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, by the petitioner, arrayed as accused No. 3 in Crime No. 182 of 2025 dated 13.12.2025, registered by Kankanady Town Police Station, Mangalore City, for the offences punishable under Section 8(c) and Section 22(c) of the NDPS Act, 1985. 2. The brief facts of the case are that, acting on credible secret information, the police on 13.12.2025 conducted a search of a car bearing Registration No. KL-58-W-6342, which was found parked by the roadside near Yashaswi Hall, Arkula, Mangalore, on suspicion of transportation and possession of narcotic drug namely MDMA. Upon search of the said vehicle, 11.53 grams of white colour crystal MDMA was seized from the possession of petitioner - accused No. 3. Further, 60.5 grams and 15.32 grams of white colour crystal MDMA were seized from the possession of accused Nos. 1 and 2, respectively. On the basis of the aforesaid seizure, an FIR came to be registered

in Crime No. 182 of 2025 by Kankanady Town Police Station for the offences stated supra. 3. The learned counsel appearing for the petitioner would submit that the essential ingredients of the alleged offences are not made out against the petitioner. It is further submitted that, as the recovery has already been effected, there is no likelihood of the petitioner tampering with the prosecution evidence or influencing the witnesses. 4. It is also contended that the grounds of arrest were not furnished to the petitioner, which vitiates the arrest as well as the subsequent remand. The learned counsel further submits that accused No. 2 has already been enlarged on bail by this Court in Criminal Petition No. 915 of 2026 dated 14.05.2026, and on the ground of parity, the petitioner also seeks to be enlarged on bail. 5. Per contra, the learned High Court Government Pleader appearing for the State of Karnataka would submit that the offence alleged against the petitioner is grave in nature, and that, if the petitioner is enlarged on bail, there is a likelihood of

his tampering with the prosecution evidence and influencing the prosecution witnesses. 6.
I have heard the submissions made by the learned counsel for the petitioner and the learned High Court Government Pleader appearing for the State, and have perused the material placed on record. 7. The FIR in the present case is registered against ten accused persons, and the petitioner is accused No.3. This Court, in Criminal Petition No. 915 of 2026 dated 14.05.2026, has already enlarged the co-accused, namely accused No. 2, on bail. A perusal of the material on record would indicate that the allegations leveled against the said co-accused, who has been granted bail, are similar to those made against the present petitioner, who is accused No. 3. 8. This Court finds no reason to take a different view in the present case, nor are any distinguishing circumstances brought on record warranting a different consideration insofar as the petitioner is concerned. In light of the above, and without expressing any opinion on the merits of the case, the petitioner—accused No. 3 is entitled to be enlarged on bail. - 5 -

9. Accordingly, the following order is passed: (i) The Criminal Petition is hereby allowed. (ii) The petitioner, accused No. 3, is ordered to be enlarged on bail in Crime No. 182 of 2025 dated 13.12.2025 registered by Kankanady Police Station, Mangalore City, for the offences punishable under Section 8(c) and Section 22(c) of the NDPS Act, 1985, subject to the following conditions: a) the accused No.3/petitioner shall execute personal bond for a sum of Rs.2,00,000/- with two local sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The accused No.3/petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts her appearance for valid reasons; c) The accused No.3/petitioner shall not involve in any offences in future.
