Kan Singh Chouhan, Senior Personel Manager, Rajasthan Housing Board, Jyoti Nagar, Jaipur. ----Respondents For Petitioner(s) : Mr. Manoj Pareek For Respondent(s) : Mr. M.F. Baig HON'BLE MR. JUSTICE ANAND SHARMA Order 21/01/2026 1. Learned counsel for the respondents submits that order dated 21.03.2022 passed by Co-ordinate Bench of this Court in S.B. Civil Writ Petition No.5317/2018 has been substantially complied with and benefits of pension, gratuity, PF and leave encashment have been given to the petitioner. 2. Learned counsel for the petitioner has raised objection with regard to making payment of lesser amount under the head of leave encashment. 3. Bare perusal of order dated 21.03.2022 would make it clear that the directions were not with regard to making payment [2026:RJ-JP:2755] (2 of 2) [CCP-704/2022] of any specific amount, therefore, when substantial compliance has been made, no case of deliberate and wilfull disobedience is made out. Hence, the present contempt petition filed by the petitioner, is hereby, dismissed. 4. However, mere dismissal of this contempt petition shall not prejudice rights of the petitioner to claim the benefit of leave encashment, if otherwise, payable under law. 5. Notices stand discharged.
