sg 14.wp(c)13316-26.docx IN THE HIGH COURT OF JUDICATURE AT BOMBAY CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 13316 OF 2026 Suvarna Popat Renuse … Petitioner versus Deputy Registrar Co Op Soc. Pune And Ors. … Respondents ---- Mr. Kishor Patil, a/w. Mr. Pratik Rahade, Mr. Amish Kikle and Ms. Akshada Nagrale, i/b. Mr. Pratik Rahade, for the Petitioner. Mr. M.M. Pable, AGP, for the Respondent/State. ---- CORAM:BHARATI DANGRE & ASHISH S. CHAVAN, JJ. DATE: 12th OCTOBER, 2026 P.C.: 1. The present writ petition is filed by the Petitioner, a former Director of Respondent No.5, Pune Municipal Corporation Servants Co-operative Urban Bank Ltd., Pune, whose tenure came to an end on 31st December, 2025, upon attaining the age of superannuation. The Petitioner had sought certain information from Respondent No.5, as she suspected irregularities in the recruitment process. Her request was rejected by a communication dated 25th March, 2026, on __________________________________________________ 12th October, 2026 SMITA JOHNSON GONSALVES Digitally signed by SMITA JOHNSON GONSALVES Date: 2026.10.13 12:48:08 +0530 sg 14.wp(c)13316-26.docx the ground that she was no longer a member of the Managing Committee, having superannuated, and that making the documents available to her would not be conducive to the smooth functioning of the present Managing Committee. Aggrieved by the aforesaid communication, the Petitioner has approached this Court, having already made several representations to the Deputy Registrar and the Divisional Joint Registrar of Co- operative Societies. Learned Counsel for the Petitioner submits that, pursuant to the said representations, certain steps have been taken by the Authorities and expects them to take the matter to its logical conclusion by completing the enquiry. We are of the view that the two Authorities, before whom the representations have been made, may take cognizance of the Petitioner's grievance by treating the representations as a source of information and, if deemed appropriate, proceed further in accordance with law. However, we do not consider it appropriate to permit the Petitioner, who is no longer a member of the Managing Committee and has superannuated, to pursue the cause espoused by her through the representations and the present writ petition. Page 2 of 3 __________________________________________________ 12th October, 2026 sg 14.wp(c)13316-26.docx We are not inclined to entertain such a challenge, particularly since the present petition is not in the nature of a public interest litigation and the Petitioner has not demonstrated any subsisting legal interest in the recruitment process. We are, however, conscious of the fact that, once the recruitment process is initiated, any individual who is aggrieved at any stage thereof would be at liberty to avail of the appropriate legal remedies available in law. In view of the above, the writ petition is dismissed. (ASHISH S. CHAVAN, J.) (BHARATI DANGRE, J.) __________________________________________________ 12th October, 2026
