1. The petitioner-Prof. Abdul Gani Bhat is present in person who as a plaintiff filed a suit on File No. 969/2025 before the court of Additional District Judge, Srinagar for damages and defamation addressed against so defendant-Mr. Fayaz Ahmad a police personnel of Police Station, Chanapora, Srinagar.
2. The institution of the suit by the petitioner had taken place on 15.04.2025 which has come to suffer dismissal by virtue of an order dated 15.06.2026 passed by the court of Additional District Judge, Srinagar, holding that the petitioner as a plaintiff has failed to discharge the burden resting upon him for enabling to earn judgement of damages and defamation against the defendant.
3. Instead of coming up with a civil first appeal under section 96 of the Code of Civil Procedure-1908 which is a legitimate right of the petitioner as an aggrieved plaintiff having suffered dismissal of his suit, the petitioner instead is coming against the Presiding Officer of the court of Additional District Judge, Srinagar with present petition.
4. This petition is utterly misconceived.
5. Considering the fact that the petitioner is acting on his own without any aid and assistance of a legal advice and counsel, as such this Court is sparing the petitioner from the burden of costs in coming up with a petition like this and leaves him
advised to come up with a regular civil first appeal to question adverse outcome of his civil suit.
6. Hence petition is not entertained and is dismissed accordingly.
