The petitioner is apprehending his arrest in connection with Tenk Narayanpur P.S. Case No. 57 of 2024, registered for the offence under Sections 223, 318(4) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Bermo at Tenughat. 3. Learned counsel appearing for the petitioner submits that the petitioner has already complied the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and in view of that he seeks permission to withdraw this petition with the liberty to move before the learned court on the strength of the judgment of Hon’ble Supreme Court in the case of Satender Kumar Antil Versus Central Bureau of Investigation & Anr., reported in (2022) 10 SCC 51. 4. Learned A.P.P. appearing for the State has got no objection. 5. Permission is accorded. 6. As such, this petition is disposed of as withdrawn with the aforesaid liberty. (Sanjay Kumar Dwivedi, J.)
