ARAVIND ORAL ORDER This petition under Section 483 of the Bharatiya Nagarika Suraksha Sanhita, 2023 (for short 'BNSS 2023') is by accused Nos.2 and 3 in Crime No.89/2026 registered by Vidyaranyapura Police Station, Bengaluru, for the offences punishable under Sections 109, 115(2), 351(2), and 352 r/w Section 3(5) of the - 3 - HC-KAR NC: 2026:KHC:24811 CRL.P No. 6096 of 2026 Bharatiya Nyaya Sanhita, 2023 (BNS), pending on the file of VII Addl. Chief Metropolitan Magistrate, Bengaluru, 2. Sri Abhinay Y., learned counsel for Sri Karthik V., learned counsel for the petitioners submit that the injuries suffered by the complainant are not grievous or life threatening and he was subsequently discharged from hospital within two weeks and the complaint suffers from gross exaggeration. It is also submitted that this Court in Criminal Petition No.5298/2026 dated 30.04.2026 granted bail to accused No.1 subject to conditions and prays for similar order by this Court. 3. Learned High Court Government Pleader (HCGP) opposing the petition submits that if the petitioners are enlarged on bail, they may tamper the prosecution witnesses and may indulge in similar criminal activities. 4. Considering the submissions made by learned counsel for the petitioners and learned HCGP and on perusal of the FIR and the orders passed by Co-ordinate Bench of this Court, this Court finds no grounds to deny bail to the petitioners. The petitioners would be entitled to bail as has been considered in the case of accused No.1. - 4 - HC-KAR NC: 2026:KHC:24811 CRL.P No. 6096 of 2026 5. In the light of the orders passed in Crl.P.No.5298/2026 dated 30.04.2026, the present petition requires to be allowed. Accordingly, this Court passes the following; ORDER (i) The Criminal Petition is allowed. (ii) The petitioners/accused Nos.2 and 3 in Crime No.89/2026 registered by Vidyaranyapura Police Station, Bengaluru, for the offences punishable under Sections 109, 115(2), 351(2), and 352 r/w Section 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS), pending on the file of VII Addl. Chief Metropolitan Magistrate, Bengaluruu, are ordered to be enlarged on bail on execution a personal bond for Rs.1 Lakh each with one surety each for the likesum to the satisfaction of the trial Court; (iii) The petitioners/accused Nos.2 and 3 shall not threaten or tamper with the prosecution witnesses or hamper the proceedings of the Court. (iv) The petitioners/accused Nos.2 and 3 shall appear before the trial Court on all hearing dates without fail unless extended. - 5 - HC-KAR NC: 2026:KHC:24811 CRL.P No. 6096 of 2026 (v) The petitioners/accused Nos.2 and 3 shall not indulge in any criminal activities.
