2. The petitioner is apprehending his arrest in connection with Barkagaon P.S. Case No.05 of 2023 corresponding to G.R. No.118 of 2024, for the alleged offences registered under Sections 414/34 of Indian Penal Code, Section 30(ii) of Coal Mines Act and Section 33 of Indian Forest Act pending in the Court of learned J.M. 1st Class, Hazaribagh.

Learned counsel appearing for the petitioner submits that the petitioner happened to be owner of the tractor and the allegations are made of carrying 3 tons of coal. He further submits that the said coal was being taken by the driver for his own use. He then submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.13 of the petition.

Learned counsel appearing for the State opposed the prayer and submits that 3 tons of coal was loaded on the tractor.

Considering that the petitioner happened to be owner of the said tractor and it has been pointed out that the driver was taking the said coal for his own use and the petitioner has got no criminal antecedent as disclosed in paragraph No.13 of the petition, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Hazaribagh in connection with Barkagaon P.S. Case No.05 of 2023 corresponding to G.R. No.118 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
