ARAVIND ORAL ORDER This petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by the petitioners/ accused Nos.1 to 4 in Crime No.249/2024 registered by Byappanahalli Police Station, Bengaluru City for the offences punishable under Sections 3(5), 324(4), 329(4), 351(2), 352 and 49 of BNS, 2023 and Section 25(1)(A) of the Indian Arms Act, 1959. 2. During pendency of the petition, learned counsel for the petitioners and learned counsel for respondent No.2 have filed a joint memo for compromise under Section 528 read with Section 359 of BNS, 2023. The joint memo reads as under: "1. The petitioners herein are facing trial in Crime No.249/2024 of Byappanahalli Police Station, which after investigation has culminated in C.C.No.50500/2025, for - 4 - HC-KAR NC: 2026:KHC:25222 CRL.P No. 7320 of 2026 the offences punishable under Sections 324(4), 329(4), 351(2), 352 and 49 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, as well as under Section 25(1)(A) of the Indian Arms Act, and the same is presently pending on the file of the Hon'ble X Additional Chief Judicial Magistrate, Mayohall, Bengaluru. 2. It is submitted that, due to the intervention of elders, well-wishers, and family members of both parties, the dispute between the Petitioners and the Complainant has been amicably settled; the parties have resolved their differences and have decided to live peacefully, and the complainant has no objection for compounding/quashing of the case and does not wish to prosecute the present case any further. 3. The petitioners and the complainant respectfully submit that this Hon'ble Court may kindly read the averments made in the main petition as part and parcel of this affidavit, to avoid repetition. Wherefore, the petitioners and the complainant most humbly pray that this Hon'ble Court be pleased to accept this joint memo of compromise and permit compounding/quash the proceedings in Crime No.249/2024 culminating in C.C.No.50500/2025 pending on the file of the Hon'ble X Additional Chief Judicial Magistrate, Mayohall, Bengaluru, in the interest of justice and equity." - 5 - HC-KAR NC: 2026:KHC:25222 CRL.P No. 7320 of 2026 3. Learned counsel for the petitioners and respondent No.2 jointly submit that the parties have compromised and the offences are compoundable. The petitioners and respondent No.2 are present before the Court and they are identified by their respective counsels. 4. Learned High Court Government Pleader appears for the respondent-State. 5. Having considered the submissions made by both the parties, the joint memo dated 19.05.2026 is taken on record. 6. In the light of the joint submissions made by the learned counsel for the parties and the settlement filed by way of joint memo, the following: ORDER i) The petition is disposed of in terms of the joint compromise petition dated 19.05.2026. - 6 - HC-KAR NC: 2026:KHC:25222 CRL.P No. 7320 of 2026 ii) The proceedings in C.C.No.50500/2025 arising out of Crime No.249/2024 for the offences punishable under Sections3(5), 324(4), 329(4), 351(2), 352 and 49 of BNS, 2023 and Section 25(1)(A) of the Indian Arms Act, 1959, pending on the file of the X Additional Chief Judicial Magistrate, Mayohall, Bengaluru insofar as the petitioners are considered, are hereby quashed.
