32-WP11644-2026.DOC Santosh IN THE HIGH COURT OF JUDICATURE AT BOMBAY CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 11644 OF 2026 Yasmin Bano Mohd Patel ...Petitioner Versus State of Maharashtra & Ors. …Respondents Mr. Bhushan Vardhamane for the Petitioner. Ms. Akansha Saxsena, ‘B’ Panel Advocate for the State. Mr. Shailesh P. Pal, for Respondent No.6.
CORAM:
N. J. JAMADAR, J. DATED:
12th OCTOBER, 2026 PC:-
1. Heard the learned Counsel for the petitioner.
2. The challenge in this petition is to an order dated 17th August, 2026, whereby the Appellate Authority has vacated the stay order dated 7th July, 2026 passed in Appeal No.488/2026. Evidently, Appeal No.488/2026 preferred under Section 35 of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 (“the Slum Act”) awaits adjudication before the Appellate Authority.
3. The impugned order does not record the pressing circumstances which warranted the vacation of the status quo
order. The resultant effect of the impugned order is that the 1/2 SANTOSH SUBHASH KULKARNI Digitally signed by SANTOSH SUBHASH KULKARNI Date: 2026.10.13 11:58:17 +0530
32-WP11644-2026.DOC appeal itself may be rendered infructuous. In these circumstances, this Court considers it appropriate to direct the Appellate Authority to hear and decide Appeal No.488/2026 itself expeditiously and, in the meanwhile, continue the stay
order dated 7th July, 2026.
4. The petition, thus, stands disposed with a direction to the Appellate Authority (R2) to hear and decide Appeal No.488/2026 as expeditiously as possible and, preferably, within a period of six weeks from the date of the communication of this order.
5. In the meanwhile, the order dated 7th July, 2026 granting stay to the execution and operation of the order dated 24th June, 2026, impugned in the said appeal, shall continue to operate till the final decision of the appeal.
