And In Re : Diwas Darjee & anr. ... Petitioners. Adv. Sourav Ganguly, Adv. Gaopal Roy, ... for the Petitioner. Adv. Saikat Chatterjee, Adv. Chattu Roy, …for the State. The petitioners are in custody for more than 100 days and pray for bail primarily on the ground that grounds of arrest have not been communicated to them at the time of their arrest and also, Section 42 of the NDPS Act has not been complied with. Learned counsel for the State opposes the prayer and produces the Case Diary which prima facie demonstrates communication of the grounds of arrest to the petitioners as well as compliance of Section 42 of the Act. Narcotic substance of commercial quantity has been recovered from the possession of the petitioners. In view of statutory restrictions laid down under Section 37 of the NDPS Act, prayer for bail is rejected at this stage. CRM (NDPS) 554 of 2025 is disposed of. 2 Case Diary be returned.
