Petitioner has filed this writ petition seeking following reliefs: “10.1 That the Hon'ble Court may kindly be pleased to call for the records of the case from the office of respondents. 10.2 That the Hon'ble Court may kindly be pleased to direct the respondents to give Contributory Pension Scheme under the Provision of paragraph 11 of the employees pension scheme 1995 in the matter of Employees Provident Fund Organization and others Vs Sunil Kumar bee and others. 10.3 That the Hon'ble Court may kindly be pleased to direct the respondents to decide the pending representation in the light of order passed by Hon'ble High Court of Madhya Pradesh at Gwalior in the matter of Anil Mehra Vs Employee Provident Fund Organization and others in accordance with law. 10.4 Any other relief, which may be deemed, fit by this Hon'ble Court just and proper in the facts and circumstances of the case may also be provided in favour of the petitioner.” 2. Learned counsel for the petitioner submits that the petitioner has 3 joined service with the respondents on 07.07.1992 as Medical Officer. Petitioner has submitted an application for voluntary retirement which was accepted and petitioner stood retired from service w.e.f 21.04.2015, during the period of service, petitioner has also opted for the CIL Executive Refined Contribution Pension Scheme, 2007 and have contributed for pension, however, after retirement petitioner was not given pension, under the scheme of 2007. He also contended that petitioner had submitted representation before respondent No. 2 to 8, which till date is pending consideration and direction be issued to the concerned authorities, to take decision on the representation submitted by the petitioner, at the earliest, within specified time frame. 3. Learned counsel for respondent No. 2 to 8 would submit as petitioner is not pressing this writ petition on merits and only seeking a direction to the respondent authorities to take decision on the representation, he is having no objection to the limited prayer. 4. Counsel for respondent No. 9 would submit that representation is submitted before respondent No. 2 to 8 and the grievance of the petitioner, from submission, is appearing against respondent No. 2 to 8. 5. On due consideration of submission of counsel for the parties, the writ petition at this stage is disposed of directing respondent No. 2 to 8 to consider and take decision on the representation submitted by the petitioner, in accordance with law, expeditiously, preferably 4 within a period of 3 months from the date of receipt of the order. It is made clear that this Court has not expressed any opinion on merits of the case and it will be for the respondents to take decision on the claim of the petitioner, in accordance with law on its own merits.
