Tikkam Ram v. The State of Himachal Pradesh
Cr. Appeal (C-DB) No.50 of 2026
30.07.2026. Present: Mr. Durga Singh Kainthla, Advocate, for the
appellant-applicant.
Mr. Raj Negi, Deputy Advocate General, for
the respondent-State.
Cr.MP No.3121 of 2026
This application has been preferred by the applicant-appellant for his temporary release for at least two days so as to enable him to make arrangement to return money borrowed by him before his arrest as the said person (lender) is now demanding money who is real uncle of the applicant- appellant.
2.
The applicant-appellant is a resident of Tehsil Sainj, District Kullu. A request has been made to allow him to visit his native place in custody of police and he is ready to bear expenses thereof.
3.
Learned Deputy Advocate General has placed on record a status report received from the Station House Officer Police Station Sainj, District Kullu, wherein it has been reported that applicant- appellant had also applied for parole, but for opposition of the victim parole was not granted.
4.
It has been further stated in the status report that during inquiry, it has been found that
Lajjae Ram [parental uncle of the applicant-appellant] aged about 76 years, disclosed that the parents of applicant-appellant have expired and his wife, along with their daughter, is residing with her parents by leaving the company of applicant-appellant and applicant-appellant has neither any brother nor any sister.
5.
According to status report after registration of FIR, Lajjae Ram [parental uncle of the applicant- appellant] had spent about Rs.2,00,000/- for contesting the case and Rs.4,00,000/- was spent for repair of house of applicant-appellant [Tikkam Ram] and he is in dire need of money and therefore he is insisting for payment. It has also been reported that applicant-appellant [Tikkam Ram] maintains a bank account with the State Bank of India, Sainj Branch, District Kullu, in which sufficient funds are available and from which the applicant-appellant can withdraw the requisite amount.
6.
The aforesaid status report is based upon the statement of uncle of applicant-appellant [Tikkam Ram]. Therefore, we are neither endorsing the liability of Rs.6,00,000/- nor repelling the same. However, the fact remains that the applicant-appellant [Tikkam
Ram] seeks time to arrange/withdraw money for clearing his debts.
7.
In aforesaid
facts and circumstances, instead of sending applicant-appellant [Tikkam Ram] in custody of police to visit Sainj, we are of the opinion that it would be appropriate to release applicant-appellant [Tikkam Ram] temporarily for a period of seven days, subject to his furnishing a personal bond in the sum of Rs.50,000/- to the satisfaction of Superintendent Model Central Jail, Nahan, District Sirmour, H.P. and also furnishing a surety bond in the like amount to the satisfaction of the Additional Registrar [Judicial] of this Court.
8.
The period of seven days shall be counted from the date of release of the applicant-appellant [Tikkam Ram] from the jail.
9.
Applicant-appellant is directed to surrender before the Superintendent Model Central Jail, Nahan, District Sirmour, H.P. on or before the expiry of seven day after his release.
10. The applicant-appellant shall not indulge in any unlawful activity during the period of temporary release and shall not visit any other place(s) except the place(s) where his presence is required for
arranging/withdrawing money and making payment thereof to clear his debt/loan.
11. The application is allowed and stands
disposed of in aforesaid terms.
