14.09.2026 The matter has been taken up today as 11.09.2026 was declared a holiday vide Notification No. 86/G-4/Genl.-I/DHC. 1. By way of the present petition, the petitioner is seeking following prayers:
“A. Issue an appropriate writ, order or direction directing Respondent Nos. 2 to 5 to expeditiously conclude the execution proceedings in Execution Case No. F.3(E-26)/EXECUTION/RERA/2023 arising out of the Recovery Certificate dated 11.08.2023 issued pursuant to the Final Order dated 13.12.2022 passed in Complaint No. 144/2021 by the Respondent No. 2, preferably within a period of two months; B. Issue an appropriate writ, order or direction directing Respondent Nos. 2 to 5 to ensure effective enforcement of the orders passed during the pendency of Execution Case No. F.3(E-26)/EXECUTION/RERA/2023, This is a digitally signed order. Issue an appropriate writ, order or direction directing Respondent Nos. 3 and 4 to file a comprehensive Status Report before this Hon'ble Court indicating the steps taken pursuant to the Recovery Certificate dated 11.08.2023, the action taken pursuant to the Attachment Order dated 23.09.2024; the present status of attachment proceedings; the present status of sale and auction proceedings; D. Award costs of the present proceedings in favour of the Petitioner.”

After hearing learned counsels appearing on behalf of the parties and in view of the issue involved in the instant petition, this Court finds it appropriate to direct that the present petition filed before this Court be treated as a representation on behalf of the petitioner, and the respondents are directed to ensure that the execution proceedings are concluded as per law, within a period of eight weeks from date, under intimation to the petitioner herein. 4. In above terms, the present petition stands disposed of. 5. In case of any further grievance, the petitioner will be at liberty to approach this Court by way of a fresh writ petition. 6.
