Order 26/02/2026
1. This bail application has been filed by the accused-petitioners under Section 483 of BNSS in connection with FIR No.352/2025 registered at Police Station Roopbas, District Bharatpur for offence(s) under Section(s) 312, 109(1), 61(1) of BNS and Section 3/25 of Arms Act.
2.
Learned counsel for the petitioners submits that the accused- petitioners have been falsely implicated in this case and they have nothing to do with the alleged offences. Learned counsel further submits that the main allegation of causing injury using fire-arm is against Chandrakesh @ Lukka @ Shiva and recovery of fire-arm has also been made from the same person. Learned counsel also submits that as per injury report, injury sustained by the injured persons is not dangerous to life.
[2026:RJ-JP:8906] (2 of 2) [CRLMB-1269/2026]
3.
Learned counsel further contends that there is no criminal antecedent against the petitioners; they are in custody since 14.11.2025 and no recovery is required to be made from them. He also submits that charge-sheet has already been filed in the matter and conclusion of trial will take considerably long time, so no fruitful purpose would be served by keeping the petitioners in custody, therefore, prays to enlarge the petitioners on bail.
4. Per contra, learned Public Prosecutor vehemently opposes the bail application.
5. Having regard to the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners; the fact that injury sustained by injured person is not dangerous to life, absence of criminal antecedent against the petitioners, charge-sheet has already been filed in the matter and trial will take considerably long time in its conclusion, without commenting anything upon the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail.
6. Therefore, this bail application is allowed and accused- petitioners, namely (1) Gurjar S/o Yogendra and (2) Sourabh S/o Yogendra, are ordered to be released on bail, provided, each of them furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the Trial Court, with the stipulation that the petitioners shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.
