Subject Matter of the case relates to quashing of the FIR in connection with Bhaktinagar Police Station case no. 1183/2025 dated 10.12.2025 under Sections 74/76/78/127(2)/64(1)/62/351(2)/61(2) of the Bharatiya Nyaya Sanhita, 2023. Learned senior advocate appearing for the petitioner submits that the allegations are cryptic and so far as the present petitioner is concerned he is a driver and hardly any materials are there to ask him to face the ordeal of criminal investigation. Learned advocate for the State has produced the Case Diary. 2 I have considered the statements appearing in the Case Diary including that of the victim under Section 183 of the BNSS. Having considered the same, I am of the view that the investigation of the case should continue. Under such circumstances liberty is granted to the petitioner to approach this Court after the charge-sheet is submitted before the jurisdictional Magistrate. No interference is made at this stage. With the aforesaid observations CRR 8 of 2026 is disposed of. Case Diary be returned to the learned advocate appearing for the State. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
