This is an application filed by the present applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’), seeking grant of regular bail in FIR No. 0102/2024 for the offences punishable under Section 377 of the Indian Penal Code, 1860 (hereinafter referred to as IPC), and Section 6 of the Protection of Children From Sexual Offences Act, 2012(hereinafter referred to as POCSO Act) registered at P.S. Paschim Vihar East, Delhi.

Learned counsel for the petitioner further submits that the victim has not supported the case of the prosecution. The allegation against the petitioner is that he is a friend of the main co-accused. It is also submitted that the victim, before the learned Trial Court, has stated that she has no objection if the petitioner is enlarged on regular bail. 5. This Court has heard the submissions made by learned counsel present for the parties. 6. In such circumstances, considering the period of custody already undergone by the petitioner, the fact that all the public witnesses stand examined, and the fact that the victim has not supported the case of the prosecution and has expressed no objection to the petitioner being enlarged on regular bail, the petitioner is entitled to consideration for grant of regular bail. 7. In view thereof, the present bail application for grant of regular bail is allowed. The applicant is directed to be released on bail, on his furnishing a personal bond of Rs. 25,000/- with one surety of like amount, to the satisfaction of the learned Trial Court/Link Court, further subject to the following conditions: i. The applicant shall not leave India without the prior permission of the learned Trial Court. ii. The applicant shall intimate the learned Trial Court, by way of an affidavit, and the Investigating Officer regarding any change in his residential address. iii. The applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing. This is a digitally signed order. iv. The applicant is directed to furnish his mobile number to the Investigating Officer and keep the same operational at all times. v. The present application for grant of regular bail is allowed and disposed of accordingly. Pending application, if any, also stands disposed of. 9. Needless to state, nothing mentioned hereinabove shall be construed as an opinion on the merits of the case, and any observations made herein are only for the purposes of the present bail application. 10.
