ARAVIND ORAL ORDER This petition under Section 483 of the Bharatiya Nagarika Suraksha Sanhita, 2023 (for short 'BNSS 2023') is by accused No.2 in S.C.No.1780/2025 arising out of Crime No.288/2025 registered by Ramamurthy Nagar Police Station, Bengaluru, for the offences punishable under Sections 61, 103(1) r/w Section 3(5) of Bharatiya Nyaya Sanhita (BNS) and Section 25(1)(B)(b) of the Arms Act, pending on the file of C/C IV Addl. City Civil and Sessions Judge, Mayohall, Bengaluru, 2. Sri Manoj S.N., learned counsel for the petitioner submits that the complaint and charge sheet provides no specific allegation or overt act attributed to the petitioner and the entire allegation is vague. It is also submitted that this Court vide order dated 19.02.2026 in Crl.P.No.14715/2025 has granted bail to the accused No.1 and prays for similar order from this Court. - 3 - HC-KAR NC: 2026:KHC:24812 CRL.P No. 6424 of 2026 3. Learned High Court Government Pleader (HCGP) opposing the petition submits that if the petitioner is enlarged on bail, he may not participate in the trial and may indulge in similar criminal activities. 4. Considering the submissions made by learned counsel for the petitioners and learned HCGP and on perusal of the FIR and the order passed by Co-ordinate Bench of this Court, this Court finds no grounds to deny bail to the petitioners. The petitioner would be entitled to bail as has been considered in the case of accused No.1. 5. In the light of the orders passed in Crl.P.No.14715/2025 dated 19.02.2026, the present petition requires to be allowed. Accordingly, this Court passes the following; ORDER (i) The Criminal Petition is allowed. (ii) The petitioner/accused No.2 in S.C.No.1780/2025 arising out of Crime No.288/2025 registered by Ramamurthy Nagar Police Station, Bengaluru, for the offences punishable under Sections 61, 103(1) r/w - 4 - HC-KAR NC: 2026:KHC:24812 CRL.P No. 6424 of 2026 Section 3(5) of Bharatiya Nyaya Sanhita (BNS) and Section 25(1)(B)(b) of the Arms Act, pending on the file of C/C IV Addl. City Civil and Sessions Judge, Mayohall, Bengaluru is ordered to be enlarged on bail on execution a personal bond for Rs.1 Lakh with one surety for the likesum to the satisfaction of the trial Court; (iii) The petitioner/accused No.2 shall not threaten or tamper with the prosecution witnesses or hamper the proceedings of the Court. (iv) The petitioner/accused No.2 shall appear before the trial Court on all hearing dates without fail unless extended. (v) The petitioner/accused No.2 shall not indulge in any criminal activities. In case, if the petitioner violates any of the bail conditions as stated above, liberty is reserved to the prosecution to file necessary application for cancellation of bail. Sd/- (K. V.
