The Court made the following ORDER:
1. This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the proceedings vide O.O.No.SAAP/Estt/ Termination/1068131/2025 dated 26.12.2025 issued by the 2nd respondent, SAAP, in terminating the petitioner from service making stigmatic allegations without conducting any enquiry or affording opportunity of hearing as illegal, arbitrary, irrational, violative of Articles 14 and 21 of the Constitution of India and principles of natural justice and consequently set aside the same and direct the respondents to reinstate the petitioner into service as Kabaddi Coach at District Sports Authority, Kadapa, YSR Kadapa District with all consequential benefits including arrears of salary and to pass such….”
2. Heard the learned counsel for the petitioners and the learned Government Pleader for the respondents. 3. The learned counsel for the petitioner submit that the 2nd respondent, SAAP, issued proceedings vide O.O.No.SAAP/Estt/Termination/1068131/2025 dated 26.12.2025 terminating the services of the petitioner by making stigmatic allegations without issuing any prior notice, without conducting any enquiry and without affording any opportunity to the petitioner to submit an explanation. Thus, the action of the respondents is in clear violation of the principles of natural justice. Therefore, the impugned proceedings are liable to be set aside. 4.
A similar issue has already been considered and decided by this Court in W.P. No.40809 of 2022 and batch cases, wherein this Court observed that once the respondents have taken the petitioners into service either on contract or on outsourcing basis, if they intend to discontinue or terminate their services, they ought to follow the prescribed procedure. In the said judgment, this Court observed that on perusal of the impugned orders, it was evident that the respondents had not followed the procedure contemplated under the relevant regulations. Apart from that, no notice or opportunity had been provided to the petitioners before terminating their services. Therefore, this Court set aside the impugned proceedings dated 28.11.2022 and directed the respondents to restore the services of the petitioners and to pay all consequential benefits. 5. In view of the submissions made and in light of the observations of this Court in the above referred judgment, this Court is of the opinion that the impugned proceedings dated 26.12.2025 cannot be sustained in law. Accordingly, the writ petition is allowed by setting aside the impugned proceedings dated 26.12.2025 and the respondents are directed to restore the services of the petitioner and pay all consequential benefits in accordance with law. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed. ___________________________ JUSTICE D RAMESH 12.03.2026 klk
