By filing instant writ petition under Article 226 of the Constitution of India, the petitioner seeks enhancement of amount of compensation being dissatisfied with the compensation awarded in his favour. 2. Learned counsel for the petitioner submits that after passing of the impugned award dated 10.7.2014 by respondent No.4, the petitioner made application (Annexure-P/6) before Sub Divisional Officer (Revenue), BINI PRADEEP Digitally signed by BINI PRADEEP Date: 2026.02.27 10:19:15 +0530 2 Aarang/Abhanpur, Distt. Raipur, however, that application was not forwarded to the Collector, Raipur. She further submits that the petitioner has not received the amount of compensation yet. She also submits that the petitioner may be permitted to withdraw this petition with liberty to file application under Section 64 of the Right to Fair Compensation & Transpierce in Land Acquisition, Rehabilitation & Resettlement Act, 2013 ( for short ‘the Act 2013’) before the Collector, Raipur for redressal of his grievance. 3. Learned counsel for the respondents/State has no objection on the above prayer. 4. Though impugned award was passed on 10.7.2014, but learned counsel for the petitioner contended that the petitioner has not received the amount of compensation, rather, he filed application (Annexure-P/6) before Sub Divisional Officer (R), Aarang/Abhanpur, whereas such application ought to have been filed before Collector, Raipur. Further, if the application (Annexure-P/6) was filed before SDO (R), then it ought to have been forwarded to the Collector, Raipur, however, it appears that the same was not forwarded. 5. In view of the above and having considered the limited prayer of the petitioner, this petition is disposed of at this stage, granting liberty to the petitioner to file appropriate application under Section 64 of the Act 2013 before the concerned Collector, within 30 days from today, for redressal of his grievance. It is further observed that in the event of filing of such application by the petitioner, the Collector, Raipur shall take steps in accordance with law, within 15 days from the date of filing of the application by the petitioner. 6.
