THIS CCC IS FILED UNDER ARTICLE 215 OF THE CONSTITUTION OF INDIA R/W SECTION 11 AND 12 OF THE CONTEMPT OF COURT ACT, 1971, BY THE COMPLAINANT, PRAYING TO INITIATE CONTEMPT PROCEEDINGS AGAINST THE ACCUSED PERSONS AND PUNISH THEM SUITABLY AND APPROPRIATELY FOR THE CONTEMPT OF COURT COMMITTED BY THE ACCUSED FOR NOT OBEYING THE
ORDER DATED 18.12.2024 PASSED BY THIS HONBLE COURT IN WP NO.34518/2024 (LB-RES).
THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MR. JUSTICE C.M. POONACHA
ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)
1. The complainant has filed the present complaint alleging wilful disobedience of the order dated 18.12.2024 passed by the learned Single Judge of this Court in Writ Petition No.34518/2024 (LB-RES) inter alia directing that the petitioner's right to participate in auction for the subject property or to make an offer in exercise of the 'Right of First Refusal', shall not be prejudiced by the institution of the said petition.

2. Apparently, the petitioner's offer for the shop in question has not been considered. Further, the petitioners have also not been afforded right of first refusal on the ground that the allocation of the shop in question was reserved for a reserved category and the petitioners do not belong to that category.
3. We note that the action of the respondents does not fall foul of the order, the disobedience of which is complained. The complainant's offer has not been rejected on the ground of her filing the petition. The complaint is accordingly closed. We, however, clarify that this would not preclude the petitioners from agitating their grievance, if any, in accordance with law.
