ORAL ORDER
This petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 by accused Nos.1 to 4 in Crime No.119/2026 registered by Chintamani Rural Police Station, Chikkaballapura District for the offences punishable under Sections 189(2), 121(2), 132, 126(2), 74 and 190 of BNS, 2023, pending on the file of Addl. Civil Judge (Jr. Dn) & JMFC Court, Chintamani.

Learned counsel for the petitioners submits that the complaint has been registered at the instance of the Police Officer alleging misbehavior with the Police Officers who were on patrol during late night. It is also submitted that offence alleged in the complaint is that of abusing the police officer and is without any prima facie evidence. It is submitted that the alleged altercation by the petitioners

with the Police Officer is concocted. It is submitted that for trivial issues, the police authorities are attempting to arrest the petitioners and to harass them.
3. Learned High Court Government Pleader for the respondent - State submits that the petitioners have obstructed discharge of duty when the police officials were on patrolling duty during late night. It is submitted that the time during which the alleged incident has taken place would prima facie indicate the occurrence of the offence. It is submitted that if the petitioners are granted anticipatory bail, they may not participate in the investigation and also indulge in similar criminal activities.
4. Considered the submissions made by the
learned counsel for the petitioners and learned HCGP. Prima facie, perusal of the facts recorded in the FIR at the instance of Police Officer would indicate the absence of ingredients to attract the alleged offences.

5. In the light of the above, this Court is of the prima facie opinion that the petitioners are required to be granted anticipatory bail. According, the following:
ORDER (a) The Criminal Petition is allowed.
(b) The respondent-Police is directed to release the petitioners/accused Nos.1 to 4, in the event of their arrest in Crime No.119/2026 registered by Chintamani Rural Police Station, Chikkaballapura District for the offences punishable under Sections 189(2), 121(1), 132, 126(2), 74 and 190 of BNS, 2023, subject to the following conditions: (i) The petitioners/accused Nos.1 to 4 shall appear before the Investigating Officer within 15 days from the date of receipt of copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh) only with two sureties for the likesum to the satisfaction of the Investigating Officer.

(ii) Petitioners shall regularly appear before the Trial court without fail unless exempted by the Trial court. (iii) Petitioners shall not tamper with the prosecution witness and shall co-operate with the Police for investigation and appear before them whenever called upon. (iv) The petitioners shall not indulge in any criminal activities. In case if the petitioners violates any of the aforesaid conditions, liberty is reserved with the prosecution to file appropriate application for cancellation of bail.
