Affidavit of service filed by the petitioner is taken on record. None appears for the victim despite service.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated. There was a consensual relationship between the petitioner and the victim. His custodial interrogation is not required.
Learned counsel for the State opposes the prayer. I have considered the material on record. Admittedly there was a consensual relationship between the petitioner and the victim. The victim is a major and was aware of the consequence of such relationship all throughout. Charge sheet has been submitted. Considering the material on record, particularly, the statement of the victim recorded under Section 183 of the BNSS and her injury
2 report and also since charge sheet has been submitted, this Court is of the view that custodial interrogation of the petitioner is not required and he may be granted anticipatory bail. Accordingly, this Court directs that in the event of arrest, the petitioner namely Arabindu Barman @ Arabind Barman be released on bail on furnishing bond of Rs.10,000/-(Rupees ten Thousand only) with two sureties of like amount each, to the satisfaction of the arresting officer subject to conditions laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner shall surrender before the jurisdictional Court and pray for regular bail within two weeks from date. CRM (A) 119 of 2026 is, thus, disposed of.
