Heard Ms. Shubhi Rusia, on behalf of Mr. Barun Kumar Mishra, learned counsel for the petitioner. Also heard Mr. Nitansh Kumar Jaiswal, learned Dy. Govt. Advocate, appearing for the Respondent/State. 2. The present petition has been filed by the petitioner with the following prayer: ALOK SHARMA Digitally signed by ALOK SHARMA Date: 2026.01.15 18:02:55 +0530 2 "(i) That, this Hon'ble Court may kindly be pleased to allow the writ petition and may further direct for proper enquiry, investigation against the culprit police officers involved in the illegal detention and arresting of the deceased namely (Dogeshwar Singh). (ii) That, this Hon'ble Court may kindly direct the respondent authorities to registered FIR against the police officer involved in the abetment to suicide of deceased (Dogeshwar Singh). (iii) Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner.” 3. Ms. Shubhi Rusia appeared before this Court on behalf of Mr. Barun Kumar Mishra. However, she does not hold any vakalatnama or authority to appear in the present matter and submits that Mr. Barun Kumar Mishra is presently at Indore and would be available only after 5th February, 2026. 4. From a perusal of the cause list and the record, it is evident that the vakalatnama in the matter has been filed jointly by Mr. Barun Kumar Mishra, Mr. Devashish Tiwari, Mr. Dinesh Kumar Bole, and Ms. Riddhi Gupta. None of the four learned counsels, who have signed the vakalatnama and are duly authorized to appear, are present before this Court. 5. Considering the aforesaid facts, this Court finds that Ms. Shubhi Rusia has no authority to appear or argue the matter on behalf of the petitioner. The Court also fails to understand that if Mr. Barun Kumar Mishra was unable to appear, why none of the other learned counsels, who are jointly authorized through the vakalatnama, 3 have appeared before this Court. Filing a joint vakalatnama without ensuring proper instructions from the client and appearance before the Court is a practice which is highly deprecated. 6. In view of the absence of any duly authorized counsel and for the reasons stated above, the matter is dismissed on this ground alone.
