ORAL ORDER
This petition under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS 2023') is by accused No.2 in Crime No. 3/2026 registered by the Ramamurthy Nagar police station for offences punishable under Sections 109(1), 115(2), 351(2), 352 read with 3(5) of Bharatiya Nyaya Sanhita
2023.
2. Sri Siddiq Hussain, learned counsel for the petitioner, submits that a co-ordinate bench of this court, vide order dated 16.03.2026 in Crl.P.No.3453/2026, has granted bail to accused Nos.1 and 4. It is submitted that the allegations made against the petitioner are identical to those of accused Nos.1 and 4.

3. Learned High Court Government Pleader submits that if the petitioner is released on bail, he may not be available for trial. It is further submitted that the petitioner could influence the prosecution witnesses and tamper with the evidence. Hence, requests this Court to dismiss the petition.
4. Having considered the submissions made by the
learned counsel for the petitioner and the learned High Court Government Pleader, the petition can be allowed only on the ground that all identical allegations arise from the very petition in the same crime number. This Court has already granted bail to accused Nos.1 and 4. The apprehension of a learned High Court Government Pleader can be safeguarded by conditions to be imposed.
5. In the light of the order passed in Crl.P.No.3453/2026 dated 16.03.2026, the present petition requires to be allowed. Accordingly, this Court passes the following:
ORDER i. The criminal petition is allowed; ii. The petitioner is ordered to be enlarged on bail in Crime No.3/2026 of respondent-police for the

aforesaid offence on executing a personal bond in a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surely for the likesum to the satisfaction of the Trial Court; iii. The petitioner shall not threaten or tamper the prosecution witnesses nor hamper the proceedings of the Court; iv. The petitioner shall appear before the Trial Court on all hearing dated without fail unless exempted; v. The petitioner shall not involve in any criminal cases.
In case, if the petitioner violate any of the bail condition as stated above, liberty is reserved to the prosecution to file necessary application for cancellation of bail.
