1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.125/2025 registered at Police Station – Marwahi District- Gaurela - Pendra - Marwahi (C.G.) for the offences punishable under Sections 04, 06, 10 C.G. 2 Prevention of Cruelty of Animals Act, 1960 and Section 61(2) & 112 of the BNS 2023. 2. The prosecution case, in brief, is that the police authorities of Police Station Marwahi received secret information from an informant to the effect that the present applicant, along with other co-accused persons, was illegally taking cattle on foot from the forest area with the intention of transporting them to another State for the purpose of slaughter. Acting upon the said information, the police party of Police Station Marwahi conducted a raid and apprehended the present applicant along with other co-accused persons at the spot and thereafter arrested them in connection with the offence. It is further stated that the anticipatory bail application of the present applicant was dismissed by the learned Court below vide order dated 02.02.2026, and hence, the present bail application has been filed before this Hon’ble Court. 3. Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated in the present case, as there is no evidence on record to suggest his involvement in the alleged offence in any manner. It is contended that the applicant has never been involved in any such activity as alleged by the prosecution and that he is a daily wage labourer earning approximately Rs. 300/- per day, which itself indicates that he has been wrongly implicated. It is further submitted that this Hon’ble Court has already granted bail to other co-accused persons in the same crime, and therefore, the present applicant is also entitled to the benefit of parity. It is also submitted that the applicant reserves his right to raise additional grounds and file further documents at the time of hearing.
The
3 applicant is a permanent resident of the address mentioned in the cause title, where his movable and immovable properties are situated, and there is no likelihood of his absconding or fleeing from justice. 4. On the other hand, learned State counsel opposed the anticipatory bail application of the applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, submissions of
learned counsel for the parties and nature of dispute and materials available on record, without further commenting anything on merits, this Court find it appropriate to grant anticipatory bail to the applicant.
7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Md. Firoz Qureshi @ Sonu, on executing a personal bond and one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his
4 adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) he shall not involve himself in any offence of similar nature in future.
