Indisputably, the issue involved in this Writ Petition is squarely covered by the several decisions of this Court including the decision of the Principal Seat in Writ Petition No.4314 of 2022 and decisions of this Bench in Writ Petition Nos.13001 of 2023, 11470 of 2022 and 11336 of 2022. 2. For the reasons stated in the aforesaid decisions and taking into consideration the submission of the learned AGP that in terms of Circular dated 13.11.2025 issued by the Government, the Commissioner of Education, Maharashtra State, Pune is the competent authority to decide the transfer of the teachers from unaided to aided school and the impugned order passed by the Respondent No.4 - 2026:BHC-AUG:47572-DB {2} 59-wp-13464-2026 Education Officer is without jurisdiction, we pass the following order. ORDER (A) The impugned order dated 01.06.2026 passed by the Respondent No.4 - Education Officer (Primary), Zilla Parishad, Latur, is hereby quashed and set aside. (B) The Respondent No. 4 - Education Officer shall forward proposal of the Petitioner to the Commissioner of Education, Maharashtra State, Pune, within two (2) weeks from the date of receipt of copy of this order. (C) The Commissioner of Education, Maharashtra State, Pune shall grant approval to the transfer of the Petitioner from unaided to partially aided post of Assistant Teacher in Indira Gandhi Primary School, Jalkot, Dist. Latur with effect from 01.01.2023, if the Petitioner fulfills the otherwise eligibility criteria, and to take further steps for release all the consequential benefits.
