Sri Bomminayuni Apparao, learned Counsel for the Petitioners submits that the impugned interference of the Respondent Police in the Petitioners’ peaceful possession and enjoyment of their business premises constitutes a manifest abuse of authority, wholly dehors jurisdiction. It is submitted that the Petitioners, having been duly licensed by the Gram Panchayat and having secured injunctive relief from the competent Civil Court, are entitled to the protection of law against arbitrary intrusion. The Respondent Police, acting at the behest of private parties and unsocial elements, have transgressed the settled principle that civil disputes cannot be converted into criminal proceedings by executive fiat. Such high‑handed action, bereft of cause of action or due process, not only undermines the Petitioners’ right to livelihood but also constitutes colourable exercise of power, violative of the principles of 3 natural justice. Hence, it is urged to restrain the Respondent Police from interfering with their civil rights. 3. Sri P.Ajay Babu, learned Assistant Government Pleader, submits that the Respondent Police have no intention to interfere in the civil dispute between the parties and that no coercive or high- handed action has been taken as alleged. The learned Assistant Government Pleader further assures that the police respect the limitations on their jurisdiction in matters of purely civil nature and, therefore, will not further intervene or meddle with the Petitioners’ business premises or civil rights, except in situations warranting action strictly in accordance with law. 4. In that view of the matter, considering the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, directing the Respondent/Police not to further call the Petitioners or not to further interfere in the civil dispute. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ________________________ Dr.Y. LAKSHMANA RAO, J Dated: 27.02.2026 VTS
