ORAL ORDER
The petitioner has filed this petition under Section 483 of BNSS, 2023 seeking enlargement on bail in C.C.No.2/2025 arising out of Crime No.32/2024 registered by the respondent for the offences punishable under Sections 316(2), 318(2), 111(2)(b) and 3(5) of BNS, 2023, pending trial before the Senior Civil Judge and Additional Chief Judicial Magistrate, Karkala. 2. The case of the prosecution is that the accused Nos.2 and 3 had unauthorisedly taken away an ATM card belonging to CW1 and replaced it by a dummy ATM card and thereafter, using the stolen ATM card withdrew cash of Rs.1,00,000/- through ten transactions of Rs.10,000/- each from various ATMs. It appears that based on the statement of the accused Nos.1, 3 and 4, the accused No.2 was arrested on
21.02.2026. After investigation, a charge sheet is filed for the offences punishable under Sections 3(5), 316(2), 318(2) and 111(2)(b) of BNS, 2023.

for releasing him on bail was rejected by the Trial Court in terms of the order dated 24.03.2026. The petitioner is therefore, before this Court seeking his release on bail. 3. The learned counsel for the petitioner submitted that the accused Nos.1 and 3 are already released on bail on 25.02.2025 and accused No.4 was released on bail on
11.03.2025. The learned counsel for the petitioner therefore prays that the petitioner be treated on par as the allegation against the petitioner is similar to the allegations against the other accused. 4. The learned High Court Government Pleader appearing for the respondent does not dispute the fact that accused Nos.1, 3 and 4 are already released on bail and the charge sheet is already filed. 5. In view of the fact that the offences alleged against the petitioner are not punishable with death or life imprisonment and in view of the fact that the other accused are already released on bail, it would be inequitable to deny the relief to the petitioner. - 4 -

6. Consequently, the petition is allowed. The petitioner is released on bail in C.C.No.2/2025 arising out of Crime No.32/2024 registered by the respondent for the offences punishable under Sections 316(2), 318(2), 111(2)(b) and 3(5) of BNS, 2023, pending trial before the Senior Civil Judge and Additional Chief Judicial Magistrate, Karkala, subject to the following conditions: i. The petitioner shall execute a personal bond for Rs.50,000/- (Rupees Fifty Thousand only) and furnish a solvent surety for the likesum and to the satisfaction of the Trial Court. ii. He shall appear before the Court on all dates of hearing unless exempted by the Court. iii. He shall not commit any offence similar to the offence of which he is accused or suspected of commission of which he is suspected. iv.
He shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to

dissuade him from disclosing such facts to the Court or to any Police Officer or tamper with the evidence. v. He shall not leave the jurisdiction of the Court without obtaining its permission. In the event of violation of any of the above conditions, it is open for the Investigating Officer / prosecution to seek for cancellation of the bail. Sd/- (R. NATARAJ) JUDGE
