JUSTICE R. NATARAJ ORAL ORDER This revision petition is filed challenging the judgment of conviction and order of sentence dated 09.03.2022 passed by the Prl. Civil Judge and JMFC, Virajpet in C.C.No.16/2015, by which, the petitioner was convicted for an offence punishable under Section 138 of the Negotiable Instruments Act. 2. When this appeal is listed for hearing on interlocutory application, a joint memo is filed by the learned counsel for the petitioner and the learned counsel for the respondent, which reads as follows: 1. That the Petitioner/accused had challenged the concurrent finding of the trial and appellant courts in convicting and sentencing the Petitioner to under go imprisonment for a period of one year and to pay fine of Rs.75,000/- and in default to under go imprisonment for a further period of 3 months etc. 2. The Petitioner submits that he had already paid a sum of Rs.1,50,000/- to the respondent/complainant through on-line on 07/05/2026 and the respondent - 3 - HC-KAR NC: 2026:KHC:25326 CRL.RP No. 615 of 2026 admits and confirm the receipt of the sum of Rs.1,50,000/- from the Petitioner. Wherefore, the Petitioner submits that the same may be recorded and necessary application for compounding the offence will be filed in due course in the interest of justice. 3. In view of the above, the petition is allowed. The impugned judgment of conviction passed by the Prl. Civil Judge and JMFC., Virajpet, dated 09.03.2022 and the judgment dated 18.03.2025 passed by the II Additional District and Sessions Judge Kodagu-Madikeri sitting at Virajpet in Criminal Appeal No.5013/2022 are set aside. 4.
