The petitioner has been made accused in connection with NDPS Case No.07 of 2025 arising out of Sisai P.S. Case No.127 of 2024 registered for the offences punishable under Sections 27(b)(ii) of the Drugs and Cosmetics Act and under Section 21, 21(c) & 22(b) of the NDPS Act. This is the second journey of the petitioner with the prayer for regular bail, earlier the prayer for regular bail of the petitioner was rejected vide order dated 27.08.2025 in B.A. No.4177 of 2025. Learned counsel for the petitioner submits that the fresh ground is that in the meanwhile three of the witnesses have been examined but none of them have stated anything about the petitioner to implicate the petitioner in this case nor they could identify the petitioner in any manner during their examination in Court. It is next submitted that the allegation against the petitioner is false. It is then submitted that there is no material in the record to suggest the involvement of the petitioner in transportation of onerex cough syrup. It is also submitted that the petitioner undertakes that he will co-operate with the trial of the case and will not annoy or disturb the informant or witnesses of the case in any manner during the trial of the case. It is lastly submitted that the petitioner has been in custody since 30.01.2025 as is evident from para-01 of this bail application. Hence it is lastly submitted that the petitioner be admitted to bail. The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gumla in connection with NDPS Case No.07 of 2025 arising out of Sisai P.S. Case No.127 of 2024 with the condition that the petitioner will co-operate with the trial of the case and will furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case.
