THIS APPEAL COMING ON FOR CONCILIATION BEFORE LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED: CONCILIATION ORDER 1. The learned counsel appearing for the respondent - claimant is present. The learned counsel appearing for the 3 appellant - Insurance Company along with its representative are present. 2. After prolonged negotiations, the matter is settled. A Joint Memo signed by the learned counsel appearing for the respondent - claimant (being authorized by the respondent - claimant to sign) and the learned counsel appearing for the appellant - Insurance Company and its authorized Officer, is filed. The respondent - claimant has agreed to receive and the appellant - Insurance Company has agreed to pay a lumpsum of Rs.10,75,000/-(Rupees Ten Lakh Seventyfive Thousand only) (inclusive of the amount already deposited, if any), instead of what has been awarded by the Claims Tribunal, in full and final settlement of the claim. 3. The appellant - Insurance Company has agreed to deposit the said amount before the Tribunal within six weeks from the date of preparation of award, failing which the said amount shall carry interest at the rate of 9% p.a. from the date of default, till the date of deposit. 4 4. The Joint Memo is accepted. 5. It is submitted by the parties that out of the total compensation amount of Rs.10,75,000/- as per the Joint Memo, 50% of the said compensation amount has already been withdrawn by the claimant. However, he has to spend for future medical expenses. Hence, the balance amount is also ordered to be released in favour of the claimant, entirely, on proper identification. 6. This Miscellaneous First Appeal stands disposed of in terms of the Joint Memo. The Judgment and Order dated 05.09.2022 in MVC No.60/2020 on the file of MACT, Bengaluru, shall stand modified accordingly. Draw up the Award accordingly. 7.
